China’s Ministry of Commerce: Launching an Unreliable Entity List Investigation on PVH Group of the United States

The Ministry of Commerce website released the “Announcement on the Launch of an Unreliable Entity List Investigation on PVH Group of the United States” on the 24th, stating that in order to safeguard national sovereignty, security and development interests, in accordance with the “Foreign Trade Law of the People’s Republic of China”, “National Security Law of the People’s Republic of China”, “Anti-Foreign Sanctions Law of the People’s Republic of China” and other relevant laws, the Unreliable Entity List Working Mechanism, in accordance with the relevant provisions of Article 2, Article 5 and Article 6 of the “Unreliable Entity List Regulations”, and based on the suggestions and reports of relevant institutions, decided to launch an investigation into PVH Group of the United States for suspected violation of normal market transaction principles, interruption of normal transactions with Chinese enterprises, other organizations or individuals, and adoption of discriminatory measures in relation to Xinjiang-related products. The relevant matters are hereby announced as follows:

1. PVH Group of the United States shall provide written materials and supporting materials to the Office of the Unreliable Entity List Working Mechanism within 30 days from the date of publication of this announcement, explaining whether there have been discriminatory measures against Xinjiang-related products in the past three years, as well as other materials required by the investigation authority.

2. During the investigation, PVH Group of the United States may make statements and defenses to the Office of the Unreliable Entity List Working Mechanism.

3. The Office of the Working Mechanism of the Unreliable Entity List shall investigate the PVH Group by questioning the parties, reviewing or copying relevant documents and materials, and other necessary means in accordance with the law, and the PVH Group and relevant companies shall cooperate.

4. During the investigation, any unit or individual may report to the Office of the Working Mechanism of the Unreliable Entity List that the US PVH Group violated normal market transaction principles, interrupted normal transactions with Chinese companies, other organizations or individuals, and took discriminatory measures against Xinjiang-related products, and shall provide relevant evidence.
